What is Probate?

Probate is the legal process of settling a person's estate after they pass away. During probate, the court appoints a Personal Representative (often referred to as an executor) to manage the estate. If the deceased had a valid will, the court will typically appoint the person named in the will. If there is no will, the court will appoint someone to serve in that role. The Personal Representative is responsible for gathering assets, paying debts, and distributing the remaining assets to the heirs or beneficiaries according to Colorado law.
